Terms of Service

1.      Acceptance of Terms and Service. The Civic Action Time Capsule provides free service to you subject to the following Terms and Conditions, which may be updated or changed by us periodically without notice to you. Any and all features that The Civic Action Time Capsule offers, now or in the future, are governed by these terms.

2.      Privacy Terms. The user's email address (as well as any other personal information) will be kept strictly confidential. While attempts are made to secure personal information from public viewing, The Civic Action Time Capsule is not responsible for the failure of any such attempts. All information you submit to The Civic Action Time Capsule may be accessible to The Civic Action Time Capsule owners, employees, partners, or other associates may be viewed or modified by them, or others associated with the operation of The Civic Action Time Capsule, for any reason at their sole discretion, including but not limited to: (a) debugging or maintaining the services The Civic Action Time Capsule provides and (b) ensuring compliance with the Terms and Conditions.

3.      User Conduct. All users must be over 13 years of age or older and agree not to use The Civic Action Time Capsule to:

a.      upload, post, link to, email or otherwise transmit any content (i) that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable; (ii) that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); (iii) that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; (iv) including unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation; or (v) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

b.      harm minors in any way;

c.      impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity while or in relation to use of The Civic Action Time Capsule; or

d.      intentionally or unintentionally violate any applicable local, state, national or international law.

4.      User Obligations. The Civic Action Time Capsule reserves the right to suspend or terminate your account and refuse any and all current or future use of The Civic Action Time Capsule (or any portion thereof).  You agree to indemnify and hold us, our parent company, any subsidiaries, affiliates, managers, members, officers and/or employees, harmless from any claim or demand, including reasonable attorneys' fees and costs, made by any third party due to or arising out of your use of The Civic Action Time Capsule and our services, the violation of this Agreement, or infringement by you, or other use of our services using your computer, of any intellectual property or any other right of any person or entity.

5.      Third-Party Sites. This service may include links to other sites on the Internet that are owned and operated by other third parties. You acknowledge that we are not responsible for the availability of, or the content located on or through, any third-party site. You should contact the site administrator or webmaster for those third-party sites if you have any concerns regarding such links or the content located on such sites. Your use of those third-party sites is subject to the terms of use and privacy policies of each site and we are not responsible therein. We encourage you to review the privacy policies of such third-party sites.

6.      Our Intellectual Property. All software, code or content included or available to end users on the Web site, including text, graphics, images and illustrations is our copyrighted material, with all rights reserved, or is the property of third parties protected by intellectual property rights. Any use of materials on the Web site, including reproduction for purposes other than those noted herein, modification, distribution, or replication, any form of data extraction or data mining, or other commercial exploitation of any kind without our prior written permission is strictly prohibited. You agree that you will not use any robot, spider, or other automatic device, or manual process to monitor or copy our web pages or the information contained therein without our prior written permission.

7.      User Content. We make no claim to ownership of the intellectual property rights in the content posted by Users, but if you post any content, you: (a) grant us a non-exclusive, payment free, perpetual, irrevocable license to reproduce, modify, delete, adapt and publish any content you post or upload and to sub-license the same for such purposes in connection with the provision of the Services as we consider necessary from time to time; and (b) you warrant that you have all necessary rights and consents in the content that you contribute and that the content does not in any way breach these Terms and Conditions.

8.      Termination. If we form the view there is a breach or threatened breach of these Terms and Conditions by you, we reserve the right to suspend or terminate your access to the Website without notice. To the maximum extent permitted at law, these Terms survive such suspension or termination. The Civic Action Time Capsule reserves the right to ban any person from using the service on the basis of past or threatened breaches of these Terms.

9.      Disclaimers. The Civic Action Time Capsule assumes no responsibility for the reliability, accessibility, timeliness, or any other quality of the services provided. Specifically, The Civic Action Time Capsule is not held responsible for any unwanted delay in delivery, loss of messages, or error in message transferred that may occur during use of this service.

10.   LIMITATION OF LIABILITY. THE USER EXPRESSLY UNDERSTANDS AND AGREES THAT THE CIVIC ACTION TIME CAPSULE (INCLUDING OUR AFFILIATES, PARTNERS, EMPLOYEES AND DIRECTORS) SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF MY TIME CAPSULE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE, INCLUDING THE FAILURE OF THE SERVICE TO PERFORM ANY ACTIVITY.  TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY CLAIMS, LIABILITIES, DAMAGES OR EXPENSES RELATING TO THIS AGREEMENT SHALL NOT EXCEED, IN THE AGGREGATE, AN AMOUNT EQUAL ONE HUNDRED DOLLARS ($100).

11.   Notice. Notices to the user may be made via email. The Civic Action Time Capsule may, but is not obliged to, provide notices of changes to the Terms and Conditions or other matters by displaying notices or links to notices to you generally on The Civic Action Time Capsule web pages.

12.   Governing Law.  These Terms and Conditions are governed by, and must be construed according to, the law in force in the District of Columbia. The Courts in the District of Columbia will have the exclusive jurisdiction to determine disputes in relation to these Terms or any other matter concerning the operation of the Website.
